2. Collection and storage of personal data and the nature and purpose of their use

a) When visiting the website

When you call up our website www.eichenberger.com, the browser used on your terminal device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file.

The following information is recorded without your intervention and stored until it is automatically deleted:

- IP address of the requesting computer,
Date and time of access,
- Name and URL of the retrieved file,
Website from which the access takes place (referrer URL),
- Browser used and, if applicable, the operating system of your computer as well as the name of your access provider.
- Amount of data transferred

The mentioned data will be processed by us for the following purposes:

- Ensure a smooth connection of the website,
- Guarantee a comfortable use of our website,
- Evaluation of system security and stability and
- For other administrative purposes.

The legal basis for the data processing is Art. 6 para. 1 sentence 1 lit. f) DSGVO. Our legitimate interest follows from the above-mentioned purposes for data collection. Under no circumstances will we use the data collected for the purpose of drawing conclusions about your person.

Furthermore, we use cookies and analysis services when you visit our website. You will find more detailed explanations on this under points 4 and 5 of this data protection declaration.

b) When using our contact, offer and inquiry forms

On our website there are contact, offer and inquiry forms which can be used for electronic contact. If a user takes advantage of such a possibility, the data entered in the input mask is transmitted to us and stored. These personal data are:

The processing of the personal data from the input mask serves us solely to process the contact. The personal data entered into the input mask serves to protect our interests in protecting secrets and to prevent misuse of the contact, offer and enquiry form, in particular by determining from whom an enquiry originates.

The personal data collected by us for the use of the contact, offer and enquiry form will be automatically deleted after completion of your enquiry.

You have the possibility to revoke your consent to the processing of your personal data at any time. In this case, the request you have made can no longer be processed.

 

3. Collection, processing, storage and transmission of data

There will be no collection, processing, storage and/or transmission of your personal data to third parties for purposes other than those listed below.

We only pass on your personal data to third parties if:

- you have given your express consent in accordance with Art. 6 Para. 1 Sentence 1 lit.

a) DSGVO
- this is legally permissible and is required under Art. 6 para. 1 sentence 1 lit.

b) DSGVO for the processing of contractual relationships with you,
- in the event that there is a legal obligation for disclosure under Art. 6 para. 1 sentence 1 lit.

c) DSGVO
- the processing is necessary in order to protect vital interests of the data subject or of another natural person pursuant to Art. 6 para. 1 sentence 1 lit.

d) DPA,
- the processing pursuant to Art. 6 para. 1 sentence 1 letter

e) DSGVO is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in us, and
- the disclosure pursuant to Art. 6 para. 1 sentence 1 letter

f) DSGVO is necessary for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data.


4. Cookies

We use cookies on our website. These are small files that are automatically created by your browser and stored on your device (laptop, tablet, smartphone or similar) when you visit our site. Cookies do not cause any damage to your terminal device, do not contain viruses, Trojans or other malware.

Information is stored in the cookie that is related to the specific terminal device used. This does not mean, however, that we obtain direct knowledge of your identity.

The use of cookies serves on the one hand to make the use of our offer more pleasant for you. For example, we use so-called session cookies to recognize that you have already visited individual pages of our website. These are automatically deleted when you leave our site.

In addition, we also use temporary cookies to optimise user-friendliness, which are stored on your end device for a certain fixed period of time. However, completely deactivating cookies may mean that you cannot use all the functions of our website.


5. Analysis tools/tracking tools

The tracking measures listed below and used by us are carried out on the basis of Art. 6 para. 1 sentence 1 letter f) DSGVO. With the tracking measures used, we want to ensure that our website is designed to meet the needs of our customers and is continuously optimised. On the other hand, we use the tracking measures to record the use of our website statistically and evaluate it for the purpose of optimising our offer for you. These interests are to be regarded as justified in the sense of the aforementioned regulation.

The respective data processing purposes and data categories can be taken from the corresponding tracking tools.

a) Google Analytics

For the purpose of designing our pages to meet your needs and continuously optimizing them, we use Google Analytics, a web analysis service of Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter "Google"). In this context, pseudonymised user profiles are created and cookies (see section 4) are used. The information generated by the cookie about your use of this website such as

- Browser type/version,
- the operating system used,
- Referrer URL (the previously visited page),
- Host name of the accessing computer (IP address),
- Time of the server request,

are transmitted to a Google server in the USA and stored there. The information is used to evaluate the use of the website, to compile reports on the website activities and to provide further services associated with the use of the website and the Internet for the purposes of market research and the design of these Internet pages in line with requirements. This information may also be transferred to third parties if required by law or if third parties process this data on our behalf. Under no circumstances will your IP address be merged with other Google data. The IP addresses are made anonymous, so that an assignment is not possible (IP masking).

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website.

b) Google Adwords Conversion Tracking

In order to record the use of our website statistically and to evaluate it for the purpose of optimizing our website for you, we also use Google Conversion Tracking. Google Adwords sets a cookie (see point 4) on your computer, if you have reached our website via a Google ad.

These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords client's website and the cookie has not yet expired, Google and the client can recognize that the user clicked on the ad and was redirected to that page.

Each Adwords client receives a different cookie. As a result, cookies cannot be tracked through the websites of Adwords clients. The information collected through the conversion cookie is used to compile conversion statistics for Adwords clients who have opted for conversion tracking. Adwords advertisers learn the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

If you do not wish to participate in the tracking process, you may refuse to accept cookies by changing your browser setting to refuse all cookies, including disabling the automatic setting of cookies. You can also disable cookies for conversion tracking by setting your browser to block cookies from the domain "www.googleadservices.com". c) Google Tag Manager

We also use Google Tag Manager, which allows you to manage analysis and tracking tags from one interface. This works to the extent that the Tag Manager detects a page load. According to the configuration, this loading of the website will trigger a Google Analytics tag. The data from this tag is then sent back to the Google Analytics servers so that a pseudonymised evaluation of user behaviour can be carried out. No cookies are set by the Google Tag Manager and no personal data is collected. d) Google DoubleClick

We use Google's DoubleClick feature on our websites to measure website usage and to enable us, Google and other advertisers who work with DoubleClick to serve you user-relevant advertising. For this purpose, a cookie is installed on the hard drive of your computer. This cookie assigns a pseudonymous identification number to your browser and collects information about the advertisements displayed in your browser and how they are accessed. The information collected by the cookie about your use of websites is usually transferred to a Google server in the USA and stored there. Based on the information collected, your browser is assigned to categories of interest. These categories are used to serve interest-based advertising.

In addition to changing your browser settings, you can also use a browser plug-in to permanently disable the DoubleClick cookie. The plug-in will preserve your opt-out settings for that browser, even if you delete all cookies. 6. Google Maps

This site uses the map service Google Maps via an API. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
To use the functions of Google Maps it is necessary to store your IP address. This information is usually transferred to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer. The use of Google Maps is in the interest of an attractive presentation of our online offers and to make it easy to find the places we have indicated on the website. This represents a legitimate interest in the sense of Art. 6 para. 1 lit. f DSGVO. Before you reach the Google map, we would also like to explicitly point out that you will reach the Google Maps map. You must confirm this information in order for the map to be loaded. 7. YouTube

Our website uses plugins from the YouTube page operated by Google. The operator of the pages is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.

When you visit one of our sites equipped with a YouTube plugin, a connection to the YouTube servers is established. This tells the YouTube server which of our pages you have visited.

If you are logged in to your YouTube account, you allow YouTube to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account.

YouTube is used in the interest of an attractive presentation of our online offers. This represents a legitimate interest in the sense of Art. 6 para. 1 lit. f DSGVO.

8. Privacy policy on the use and application of Shariff

The data controller has integrated the Shariff component on this website. The Shariff component provides social media buttons that comply with data protection regulations. Shariff was developed for the German computer magazine c't and is published by GitHub, Inc.

The component was developed by GitHub, Inc. 88 Colin P. Kelly Junior Street, San Francisco, CA 94107, USA.

Button solutions provided by social networks usually transfer personal data to the respective social network as soon as a user visits a website in which a social media button has been integrated. By using the Shariff component, personal data is only transmitted to social networks when the visitor to an Internet page actively presses one of the social media buttons. The purpose of using the Shariff component is to protect the personal data of visitors to our website and at the same time to enable us to integrate a social media button solution on this website.

Facebook plugins (Like & Share button)

Our pages integrate plugins from the social network Facebook, provider Facebook Inc. 1 Hacker Way, Menlo Park, California 94025, USA. You can recognize the Facebook plugins by the Facebook logo or the "Like Button" ("Like") on our site. When you visit our pages, the plugin establishes a direct connection between your browser and the Facebook server. Facebook thereby receives the information that you have visited our site with your IP address. If you click the Facebook "Like-Button" while you are logged in to your Facebook account, you can link the contents of our Pages on your Facebook profile. This allows Facebook to associate your visit to our Pages with your user account. Collection and sharing of information: You can use the Google+ button to publish information worldwide. The Google+ button allows you and others to receive personalized content from Google and our partners. Google stores both the information that you gave for a +1 content and information about the page you viewed when you clicked +1. Google records information about your +1 activity in order to improve the Google services for you and others. To use the Google+ button, you must have a public Google profile that is visible worldwide and must contain at least the name you choose for your profile. This name is used in all Google services. In some cases, this name may also replace another name that you used when sharing content through your Google Account. Use of the information collected: In addition to the uses described above, the information you provide will be used in accordance with the applicable Google Privacy Policy. Google may publish aggregate statistics about users' +1 activity and may share these statistics with users and partners, such as publishers, advertisers, or affiliated websites.


WhatsApp plugin

Our website uses plugins from the Facebook operated App WhatsApp. The app is operated by Facebook Inc, 1 Hacker Way, Menlo Park, California 94025, USA.

We have no influence on whether and to what extent WhatsApp collects personal data by sharing our content. We are also not aware of the scope, purpose, or retention period of the data collection. It must be assumed that at least the IP address and device-related information is collected and used. It is also possible that WhatsApp uses cookies. 9. Site Search 360

Our website uses plugins of the search engine Site Search 360 operated by SEMKNOX, which is operated by SEMKNOX GmbH, Webergasse 1, Haus B/1, 01067 Dresden, Germany.

When the websites are called up, no personal data are transmitted to the provider of the search service (SEMKNOX). Data is transmitted to SEMKNOX only when the search field on this website is used. The data transferred are the search terms you have entered. The IP address of the computer you are using is not transmitted. The search service is at no time able to assign your entered search terms to the IP address of the computer you are using.

10. TraceParts

On our web pages, we link to the TraceParts CAD parts library of TraceParts S.A., Parc Eco Normandie, 76430 Saint Romain, France (hereinafter referred to as "TraceParts"). The links are located in the respective product area of our products and are marked "Download CAD data". 

When you access a page of our website, no connection is established with the TraceParts servers. If you click on the corresponding link, you give your consent according to art. 6 par. 1 lit. a DSGVO and you will be redirected to the TraceParts website. We have no influence on the processing of personal data on third party websites. According to its own statements, the provider of the CAD component drawings fulfills the requirements of the EU data protection basic regulation. 

As a visitor to the traceparts.com website, you must register in order to use the website and to download free CAD models in various formats. This registration process is based on the detailed TraceParts General Terms of Use.

Here it is clearly explained which data is collected for which purpose and how. The privacy policy also clearly defines the rights of users to access, modify and delete their personal data and data stored by TraceParts. 

Access to user data is restricted in both physical and electronic form and user passwords are encrypted. Any access to this user data is logged and archived with all details. These logs are regularly reviewed by the TraceParts security team and checked for unusual events. TraceParts uses security notification procedures to ensure that advanced reports can be generated promptly in the event of a data breach. 

The user data is stored exclusively on TraceParts' proprietary servers. These are located in the data center of a professional third party provider in France. TraceParts directly and exclusively takes care of the hosting, processing and storage of this data. By accessing the TraceParts web site, your browser establishes a direct connection to these TraceParts servers. You must be aware that we do not acquire any knowledge of the content of the data transmitted and their use by TraceParts.

11. myFonts

The design of our website also uses external fonts provided by the company MyFonts Inc., 600 Unicorn Park Drive, Woburn, MA 01801, USA (hereinafter: MyFonts). These fonts are integrated by a server call to MyFonts. To deliver the font files to your browser, at least your IP address is transmitted to a MyFonts server when you call up our website. In addition, further information (e.g. name of the website called up, date and time of the request, type of web browser used) may be transmitted to MyFonts. 12. Rights of data subjects

You have the right:

- to request information about your personal data processed by us in accordance with Art. 15 DSGVO. In particular, you may request information on the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right of rectification, cancellation, restriction of processing or opposition, the existence of a right of appeal, the origin of your data, if not collected by us, as well as the existence of automated decision making including profiling and, if applicable, meaningful information on the details of the data;
- in accordance with Art. 16 DSGVO, to demand without delay the correction of incorrect or incomplete personal data stored by us;
- pursuant to Art. 17 DSGVO to demand the deletion of your personal data stored with us, unless processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
- pursuant to Art. 18 DSGVO, to demand the restriction of the processing of your personal data, insofar as a) the accuracy of the data is disputed by you, b) the processing is unlawful, but you refuse to delete it, c) we no longer need the data, but you do need it for the assertion, exercise or defence of legal claims or d) you have lodged an objection to the processing pursuant to Art. 21 DSGVO;
- in accordance with Art. 20 DSGVO, to receive your personal data that you have provided us with in a structured, common and machine-readable format or to request that it be transferred to another responsible party;
- in accordance with Art. 7 para. 3 DSGVO, to revoke your consent to us at any time. As a result, we may no longer continue to process the data which was based on this consent in the future; and
- complain to a supervisory authority pursuant to Art. 77 DSGVO. As a rule, you can turn to the supervisory authority of your usual place of residence or workplace or to the supervisory authority of our head office.
- to be informed, in accordance with Art. 19 DSGVO, of the recipients of the personal data concerning you to whom the relevant information has been disclosed by the person responsible If you have asserted the right to rectification, erasure or limitation of processing vis-à-vis the controller, the latter is also obliged to notify all recipients to whom the personal data concerning you have been disclosed of such rectification, erasure or limitation of processing, unless this proves impossible or involves a disproportionate effort.
- in accordance with Art. 21 DPA, to object at any time, for reasons arising from their particular situation, to the processing of personal data concerning you which is carried out on the basis of Art. 6 para. 1 letter e or f DPA; this also applies to profiling based on these provisions. For further information, please refer to Art. 21 and 22 DSGVO. 

 

13. Right of objection

If your personal data are processed on the basis of legitimate interests in accordance with Art. 6 para. 1 sentence 1 letter f) DPA, you have the right to object to the processing of your personal data in accordance with Art. 21 DPA, if there are reasons for doing so arising from your particular situation or if the objection is directed against direct marketing. In the latter case, you have a general right of objection, which will be implemented by us without indicating any special situation.

14. Data security

We use the common SSL (Secure Socket Layer) procedure within the website visit in connection with the highest encryption level supported by your browser. As a rule, this is a 256 bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is being transmitted in encrypted form by the closed display of the key or lock symbol in the status bar of your browser.

We also use suitable technical and organisational security measures to protect your data against accidental or deliberate manipulation, partial or complete loss, destruction or unauthorised access by third parties. Our security measures are continuously improved in line with technological developments.

We use HubSpot for our online marketing activities. This is an integrated software solution with which we cover various aspects of our online marketing.

E-mail marketing (newsletters and automated mailings, for example to provide downloads)

contact management (CRM)
Landing Pages and Contact Forms

With our registration service, we enable our website visitors to learn more about our company, download content and provide their contact information and other demographic information. This information is stored on servers of our software partner HubSpot. We may use this information to contact visitors to our site and to determine which of our company's services are of interest to them.

All information collected by us is subject to this Privacy Policy. We use all information collected solely to improve our marketing.
